Mother's Day Competition

General

  1. The competition is a game of skill, chance does not form part of selecting the winner.
  2. The material used to market and promote the competition forms part of the competition terms. If there is an inconsistency between the material used to market and promote the competition and the competition terms, the competition terms prevail.

Eligibility to enter

  1. During the Competition Period, anyone may enter the competition, provided that they are:
  • over 18 years of age;
  • a resident of Australia (excluding NT); and
  • not an employee, or immediate family member of an employee, of the Promoter or not an agent of the Promoter who is connected with the competition.

Entering

  1. By entering the competition, entrants accept the competition terms.
  2. To enter, entrants must between 12.01am (AEST) on 1st May 2024 to 11:59pm AEST 12th May 2024 (Competition Period) do the following:
  3. ‘Follow’ our Instagram page @firstchoiceliquormarket
  4. Tag a ‘mother figure’
  5. Comment your response to the following question: “‘Why your Mum deserves these goodies?”

Instagram account can enter as many times as they like. Each tagged friend must be 18+ in age.

  1. The Promoter may deem as invalid any entry which:
  • is illegible, incomprehensible, offensive or incomplete; or
  • includes objectionable, profane, insulting, inflammatory or defamatory material
  • violates our social media policy or any law or code.
  1. The promoter may disqualify any entrant who:
  • enters the competition without being eligible;
  • tampers with the entry process;
  • submits an entry that is not in accordance with the competition terms; or
  • in entering the competition, engages in conduct which is fraudulent, misleading, deceptive or damaging to the goodwill or reputation of the competition or the Promoter.
  1. Failure by the Promoter to exercise its rights under paragraph 6 or paragraph 7 does not constitute a waiver of the promoter’s rights under paragraph 6 or paragraph 7.
  2. If the entrant’s contact details change, the entrant must notify the Promoter.
  3. By entering, each entrant gives the Promoter consent to repost their entries on the First Choice Liquor Market Instagram (@Firstchoiceliquormarket) feed or stories, for the purpose of marketing or promoting the competition, the Promotor or the Promoter’s business, subject to credit being provided to the entrant’s Instagram handle.

 

Selecting winners

  1. The Promoter will select the winner from the pool of valid entrants at the selection time on the selection date at the selection address.
  2. The Promoter will select the winner on the basis of most creative answer to the question as outlined in paragraph 5. The Promoter’s selection is final and binding, subject to the promoter’s rights under paragraph 6 or paragraph 7.
  3. The Promoter will notify the winner within 2 days after the selection date. The Promoter will post the winner’s name & Instagram handle on the competition post within 2 days after the draw date.

Awarding prizes

  1. The Promoter may request that the winner provides proof of identity, proof of age and proof of residency to the Promoter’s reasonable satisfaction before awarding the prize. If the winner does not provide proof of identity, proof of age or proof of residency to the Promoter’s reasonable satisfaction within 1 month after being selected as a winner and runners-up, the Promoter may forfeit the prize.
  2. The winner must accept the prize within five working days after the event, after being selected as the winner and runners-up. The prize may be forfeited by the Promoter if the prize is not accepted by the winner within five working days after being notified of their win.
  3. In consideration of the Promoter awarding the prize to the winner, the winner:
  • consents to the Promoter using his or her name, likeness, image, voice and entry (including their Instagram handle) in any marketing and promotion of the competition, the Promoter or the Promoter’s business;
  • agrees to use the Prize in accordance with the prize supplier’s specified requirements; and
  • agrees that the Prize is not transferable or exchangeable and cannot be taken as cash.
  1. If the Prize is unavailable, the Promoter may substitute the Prize with a substitute prize, provided that the substitute prize is of the same or similar value or specification as the prize.

 

Force majeure

  1. If there is a force majeure event which prevents or materially and adversely affects the Promoter’s ability to market, promote and run the competition in accordance with the competition terms, the Promoter may cancel, terminate, modify, suspend or postpone the competition.

Liability

  1. The Promoter is not liable for any loss, expense, damage or liability suffered or incurred by entrants and winners in connection with the competition, including:
  • any late, lost, altered, damaged or misdirected entries or prize acceptance, including delays due to technical disruptions or network congestion;
  • any incorrect or inaccurate information caused by equipment or programming associated with or utilised in the competition;
  • any technical error, including any omission, interruption, deletion, defect, delay in operation or transmission or communications line, telephone, mobile or satellite network failure; and
  • any theft, destruction, unauthorised access to or alteration of entries; and
  • any use of the prize or any tax liability incurred by the winner as a result of accepting the prize.
  1. Nothing under paragraph 22 is intended to limit entrants’ or the winner’s rights under the Australian Consumer Law 2010.
  2. This promotion is in no way sponsored, endorsed or administered by, or associated with, Instagram and Instagram is not liable for any loss, expense, damage or liability suffered or incurred by entrants and winners in connection with the competition, including anything detailed in Section 19. Entry and participation in the Promotion is dependent on entrants acting in accordance with the Instagram Terms of Use (available at https://help.instagram.com/581066165581870); and the entrant releases Instagram and its associated companies from any and all liability arising in relation to this Promotion.

 

Personal information

 

  1. The Promoter collects personal information about entrants in order to run the competition. The Promoter uses and manages entrants personal information in accordance with its privacy policy at www.coles.com.au/privacy. By entering the competition, each entrant consents to the Promoter using their personal information for future marketing and promotional purposes.
  2. By entering, the winner and runners-up understands and acknowledges that the Promoter will share their personal information specifically full name and delivery address to the supplier Carlton & United Breweries for the purpose of arranging the prize.
  3. By entering, the entrants/winner give the Promoter, consent to use their Instagram handle in the winner announcement post.
